Do city parks close at night?

Yes, all Fruita city parks are open from 6 a.m. - 11 p.m. except for Snooks Bottom which is open from 8 a.m. - 10 p.m. City parks have hours of operation to keep the community safe. All park usage areas including bathrooms and gates are unlocked by 8 a.m. and locked by 11 p.m. Other rules of city parks include no overnight parking, no smoking, no alcohol or glass containers, picking up after yourself, and keeping dogs on leash.

Do Parks and Recreation offer scholarship opportunities for recreational sports and activities?

Yes! You can fill out a Recreational Scholarship. To be eligible, the program participant must be under 18, live in Mesa County, and needs to provide a current free/reduced lunch approved letter from School District 51, or a Medicaid card, Marillac Clinic Card, or a CHP+Card.

Why doesn’t Fruita have a Fall/Spring Clean-Up Program?

Due to the small population size of Fruita, and to save costs for residents, the city's trash services are contracted out to a private company instead of being as a municipal program. In the past, the City of Fruita has evaluated the costs of providing a spring and/or fall clean-up for residents like the program in Grand Junction (where residents can leave an unlimited amount of trash on the curbs to be collected, with exception of certain items), but the cost from the contracted provider was too prohibitive at the time. Since the City’s trash fund is fully funded through user fees, this additional cost would have to be passed on to residents in significantly increased monthly fees, and the City decided against that. To help with spring trash collection, however, the City last year started hosting clean-up events at the City Shop building, which is advertised on the city's website, social media, and here in the Weekly Update. This year, Fruita residents filled up two 30-yard dumpsters as part of the program, and it is scheduled to continue next year. We will, however, continue to look into options to bring a fully operational spring and fall clean-up to Fruita and will share widely if this service becomes available.

Why is there property called the Fruita Division of the Grand Mesa National Forest?

The City of Fruita owns three reservoirs on the Pinion Mesa near Glade Park, CO. Historically, (prior to 1980) these reservoirs supplied domestic water to Fruita. As Fruita grew, the water from the reservoirs was not sufficient for Fruita. Today, these reservoirs are for recreational use and deliver water to the Glade Park area for irrigation. A dog is running at-large in my neighborhood – now what?

If the dog show signs of viciousness or aggressive behavior, call 911.  The Animal Control Officer or a Police Officer will respond as quickly as possible. 
If you know where the dog lives, tell the dog to “go home” or contact the owners.  The vast majorities of dogs return home without the need for capture or impound.
If you find a dog at large and harbor the animal while trying to locate the owner, the Grand Junction Sentinel, The Free Press, The Moose, and KEKB radio stations provide free lost and found pets announcements.
A group of Mesa County residents recently started a Facebook account under the name of “Mesa County Lost and Found Pets”.  This is a good resource for posting found dogs or cats.

Are there any exemptions to the bag fee?
  • Small stores with three or fewer locations in Colorado and not part of a franchise, corporation or partnership that has physical locations outside of Colorado
  • Customers who provide evidence of participating in a federal or state food assistance program are exempt from the carryout bag fee.
  • The single-use carryout bag fee does not apply to:
    • A bag made of paper when the paper has a basis weight of thirty pounds or less
    • Bags provided by pharmacists to contain prescription medications
    • Laundry, dry cleaning, or garment bag
    • Bags used by consumers inside stores to:
      • Package bulk items, such as fruit, vegetables, nuts, grains, candy, or small hardware items
      • Contain or wrap frozen foods, meat, or fish, flowers, potted plants, or other items where it could dampen or contaminate other items
      • Contain unwrapped prepared foods or bakery goods

Are there any guidelines for how to use the 96-gallon carts?

Place cart with wheels facing curb and position three feet from any other object (mailbox, car, light pole, trees, fences, etc.).

Be sure all trash is bagged and fits in the cart with the lid closed. This is to help limit debris when the automated trucks pick up the trash cans. 

Have your cart at the curb by 7:00 a.m. on collection day. Your pickup may occur later in the day, but routes can vary, so be sure to have it out early.

Are there exceptions to the prohibition of using single-use plastic carryout bag for retail food establishments?

Retail food establishments need not comply with the prohibition on the use of singleuse plastic carryout bags if the retail food establishment:

  • Prepares or serves food in individual portions for immediate on-or-off premises consumption; and
  • Is not a grocery store or convenience store.

Are there off-road trails for use?

Can I be in Teen Court?

Juvenile defendants are eligible to participate in Teen Court. Teen Court is the sentencing phase of your court hearing. A juvenile defendant must plead guilty to his/her offense to be considered for Teen Court and in most cases must be a first time defendant. Teen Court is a privilege and is not granted in cases or situations.

Can I file for divorce in Fruita?

No. Fruita Municipal Court is a court of record with limited jurisdiction. The Court only hears traffic, city ordinance and misdemeanor offenses that occur in the city limits of Fruita. Mesa County will need to handle divorce proceedings

Can I get a copy of the police report?

Yes. You may contact Fruita Police Department at 101 E. McCune in person and must present a photo ID to receive a copy. The court does NOT provide copies of the police reports or citations.

Can I have an Accessory Dwelling Unit (ADU) on my property?

There are multiple variables to review to determine if a property can have an accessory dwelling unit (ADU). The first variable to be considered is what zoning area the property falls under. Accessory Dwelling Units (ADUs) are permitted on property with a single-family detached house in the following zones: Rural Estate (RE), Large Lot Residential (LLP), Community Residential (CR), South Fruita Residential (SFR), Monument Preservation (MP), Neighborhood Commerical Overlay, Downtown Mixed Use (DMU), and Commerical-1 (C-1). If you don’t know what zoning district your property is located in, take a look at the City’s GIS Map. In the map’s “Layer List,” make sure the “Existing Zoning District” option is selected. In addition to meeting zoning requirements, an ADU must meet setback requirements, height requirements, and lot coverage requirements. Property owners looking to have an ADU need to know where easements are on the property and follow HOA guidelines if in a neighborhood with an HOA. Can I leave extra materials next to or on top of the cart?

All materials must be contained inside the cart. Drivers cannot service carts with materials on top. If a household has more trash than can fit in the 96-gallon cart, the household will need to order an additional cart from Waste Management. To order an additional cart, please give us a call at 970-858-3663.

Can I mail my payment for a citation or ticket?

Yes. The Court mailing address is 325 E. Aspen, Fruita, CO 81521. Check should be made payable to the City of Fruita. Make sure that you reference your citation number or the case number on your check.

Can I reuse the paper or plastic bags I have at home?

Yes, the fee is only charged the first time a bag is given to a customer. Any bag can be brought to the store for reuse.

Can I run a business out of my house?

Yes, this is called a home occupation business and there are several requirements that must be met for these types of uses.  Only the people who live at the house are permitted to be work at the house as part of the home occupation.  Advertising signs, outdoor operations, or businesses that create objectionable noise, dust, or odors are not permitted with a home occupation.  On-site retail sales also is not permitted as a home occupation.   A City of Fruita business license is required for home occupation businesses and all other state and federal rules and permits are required to be obtained before the business becomes operational.  The regulations for home occupations are found in Section 17.05.100 (B), Supplemental Zoning Regulations and Standards, of the Fruita Land Use Code: Chapter 17.05 Land Use Code (fruita.org).

Can my permit for a Short-term Rental be revoked?

A Short-Term Rental Permit can be revoked if:

  • Staff has determined that any of the following have occurred:
    • The owner or designated responsible party has failed to comply with any requirement of Section 17.09.100 of this Title.
    • The owner or designated responsible party has failed to comply with a condition of or restriction set forth in the Short-Term Rental Permit.
    • The owner has failed to collect or remit lodging or sales taxes or otherwise comply with local, State and/or federal tax requirements.
    • Materially false or misleading information has been provided to the City by the applicant, owner or designated responsible party on an application.
    • The City has received excessive and substantial complaints by neighbors or affected persons, which complaints were not adequately and timely addressed by the owner or Local Point of Contact as determined solely by the City.
    • Short-Term Rentals are required to be rented for a minimum of 45 days in a calendar year. Failure to rent the property will cause the property to be ineligible for renewal in the subsequent year.

Do I need a business license in the City of Fruita and how do I get one?

If you are doing business in the City of Fruita, you need to have a business license. You may find the business license application on this website under Business Licenses. You may also pick up the application at the City Clerk’s Office at the Fruita Civic Center, 325 E. Aspen, Fruita, CO. The annual fee for a business license is $30.00, payable by check, cash or credit card. You will receive a renewal form in the mail at the end of each calendar year for the following year.
